Booking Terms & Conditions

These Booking Terms & Conditions ('Terms') govern marathon-travel packages offered by Stride With Pride Marathon Tours LLC, New York City, New York ('SWP,' 'we,' 'us,' or 'our'). By reserving a package and paying a deposit, you ('traveler,' 'you,' or 'participant') agree to these Terms and any package-specific order terms shown at checkout (together, the 'Agreement'). If order-specific terms conflict with these Terms, the order-specific terms control.

1. Scope of Services

Stride With Pride Marathon Tours LLC curates marathon-focused travel experiences that may include race-entry facilitation, hotel accommodations, select meals, ground transportation, and group sightseeing or cultural activities. We do not sell or arrange flights.

2. Reservations & Eligibility

Booking: Complete our online reservation and pay the required non-refundable deposit. A booking is confirmed only once you receive written confirmation from SWP.

Race entries: Guaranteed entries, when offered, are available only with an SWP package and remain subject to acceptance by the official race organizer. Entries are personal, non-transferable, and not for resale.

Who may join: Participants must be at least 18 years old (or traveling with a parent/guardian who is also booked) and must meet the race organizer’s eligibility requirements.

3. Pricing & Currency

All prices are listed and processed in U.S. dollars (USD). Prices are based on current supplier rates and exchange rates. If cumulative tax or currency fluctuations exceed 6% between launch and final payment, SWP may adjust prices by up to 6%. If the increase would exceed 6%, you may cancel within 5 days of notice for a full refund of amounts paid (excluding non-refundable race fees already remitted). Single rooms require a single-supplement fee shown at checkout. SWP does not roommate-match.

4. Payments

Deposit: Non-refundable and due at booking. Race entry fees: Non-refundable and often due in full at booking. Final payment: Due 120 days before departure unless stated otherwise. Late payment: $25 late fee after the deadline; bookings more than 5 days past due may be treated as cancelled (see Section 6). Accepted forms: major credit cards and any other methods listed at checkout. Orders may be cancelled if billing cannot be verified.

5. Changes

After final payment, change requests are subject to a $40 per-person change fee (or $75 if requested within 30 days of departure) plus any supplier charges. SWP cannot guarantee that changes are possible.

6. Cancellations & Refunds

If you cancel: Deposits and race-entry fees are non-refundable. ≥ 120 days before departure: 50% refund of amounts paid, excluding non-refundable items. < 120 days: No refund. SWP strongly recommends that you purchase comprehensive travel insurance. Before filing a credit-card dispute ('chargeback'), please contact us—we will attempt to resolve the issue quickly. Unwarranted chargebacks may be treated as cancellations under this policy.

7. Event or Supplier Cancellation

If a race or supplier cancels or materially changes its services, SWP will seek refunds or credits on your behalf and will pass through to you any amounts actually received from those suppliers, less unrecoverable costs and reasonable processing fees.

8. Force Majeure

SWP is not liable for failure or delay caused by circumstances beyond our reasonable control, including acts of God, extreme weather, strikes, war, terrorism, public-health emergencies, or governmental actions. In such cases, itineraries may change or be cancelled, and any refunds or credits will be limited to supplier amounts actually recovered.

9. Health & Fitness

You are responsible for ensuring you are medically and physically fit to participate. Obtain and carry required passports, visas, and vaccinations. All activities are undertaken at your own risk.

10. Code of Conduct / Inclusive Policy

Stride With Pride exists to provide an inclusive, harassment-free experience for all. We may remove (without refund) any participant whose behavior endangers others, violates laws or race rules, or constitutes harassment or discrimination. You are responsible for any property damage or incidental charges incurred.

11. Travel Insurance

Comprehensive travel insurance is strongly recommended (trip cancellation, interruption, medical, baggage, and race participation coverage). Insurance is not included and must be purchased separately.

12. Our Role & Liability

SWP acts as an independent organizer coordinating services from independent suppliers (race organizers, hotels, transport companies, guides, restaurants, etc.). We are not responsible for acts or omissions of suppliers or for events beyond our control. To the maximum extent permitted by law, SWP’s total liability shall not exceed the amounts you paid to SWP for the affected package. We are not liable for indirect, incidental, special, or consequential damages.

13. Photos & Media

By joining a tour, you grant SWP a non-exclusive, royalty-free license to use photos or videos depicting your participation for promotional purposes. To opt out, email mailto:run@swptours.com before departure and inform on-site staff at check-in.

14. Privacy

Your personal data is handled in accordance with our Privacy Policy (linked on our website). We use your data only to operate your booking, communicate about your trip, and—if you opt in—share future offers.

15. Governing Law & Venue

These Terms are governed by the laws of the State of New York. Any dispute arising out of or relating to this Agreement shall be brought exclusively in the state or federal courts located in New York City, New York, and both parties consent to the jurisdiction of those courts.

16. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. A valid clause that most closely reflects the parties’ intent will replace the invalid provision.
